Bloomberg – Apple Sues Amazon.com, Seeks Order to Stop Use of ‘App Store’ Trademark

Apple Inc. (AAPL) sued Amazon.com Inc., saying the online retailer is improperly using Apple’s “App Store” trademark for a mobile software developer program.

Apple, in a complaint filed March 18 in California, accused Amazon.com of trademark infringement and unfair competition and asked for a court order to prevent the company from using the “App Store” name, as well as for unspecified damages.

“Amazon has begun improperly using Apple’s App Store mark in connection with Amazon’s mobile software developer program,” Apple said in the complaint. Amazon also plans to use the name with a mobile software download service, the complaint states.

This is a kind of software fraud we’ve never even heard of: a pirate simply downloading the app and resubmitting it to the same distribution channel at a lower price. We immediately emailed Apple explaining the situation, expecting them to quickly investigate the situation, shut down the fraudulent app, and follow up with us. We started this process a few days ago, and haven’t heard back from Apple yet.

BBC News – Microsoft seeks to block Apple ‘App Store’ trademark

Microsoft has said that it has asked US officials to block Apple’s attempt to trademark the words "App Store".

Apple submitted an application for the phrase – used for its iPhone, iPad and Macintosh download services – in 2008.

But Microsoft has now told BBC News that it has asked the US Patent and Trademark Office to reject the application.

The company says the term is too generic and competitors should be able to use it.

Giving Up On Patents – ongoing

Not so many years ago, even as I was filled with fear and loathing of the hideous misconduct of the US Patent & Trademark Office, I retained some respect for the notion of patents. I even wrote what I think is an unusually easy-to-read introduction to Patent Theory. But no more. The whole thing is too broken to be fixed. Maybe it worked once, but it doesn’t any more. The patent system needs to be torn down and thrown out.
